These Terms of Service ("Terms") govern your use of the GigMe mobile app and mygigme.com (together, the "Service"). By using the Service you agree to these Terms. When you create an account in the GigMe app you are asked to affirmatively accept these Terms, and GigMe records the version you accepted together with the date and time.
GigMe is an income-tracking and document-generation tool for self-employed workers. GigMe is not a bank. GigMe is not your employer. GigMe is not a tax preparer, accountant, or attorney. GigMe records the income you self-report and helps you connect with third parties (such as IRS-authorized Certifying Acceptance Agents and the payment processor Stripe).
All income you log in GigMe is self-reported. Pay stubs you generate display amounts you entered and clearly state that GigMe does not independently verify them. You are responsible for the accuracy of any income you report and for any tax, immigration, lending, or legal use of the resulting pay stubs.
Deposits are processed by Stripe through hosted Checkout. By making a deposit you also agree to Stripe's terms at stripe.com/legal. GigMe is not responsible for delays, holds, or reversals imposed by Stripe or by your bank.
CAAs listed in the app are independent IRS-authorized professionals. GigMe does not provide tax, immigration, or legal advice and is not responsible for the work, fees, or outcomes of any CAA you choose to contact.
You are responsible for the device you use to access GigMe and for keeping it secure. If you lose access to your device you may lose access to your GigMe data, including the on-device-only identity and bank information described in our Privacy Policy.
We may suspend or terminate access to anyone who violates these rules.
GigMe is only a tool for tracking income and generating documents. GigMe is not your employer, partner, agent, or client. GigMe does not hire you, assign you work, supervise you, set your pay, or control how, when, or where you do your work. You are an independent worker, solely responsible for the services and work you perform for any third party.
To the maximum extent permitted by law, GigMe is not responsible or liable for anything you do outside of the app, including but not limited to: the work or services you perform; any injury, death, property damage, accident, or harm you cause or suffer while working; any dispute with a client, customer, employer, platform, or other person; the quality, legality, safety, or outcome of your work; any contract you enter into; and any tax, immigration, licensing, insurance, or legal consequence of your activities. Any claim arising out of your work or conduct is between you and the other people involved — not GigMe.
You agree to indemnify and hold harmless GigMe and its operators from any claim, loss, or demand brought by a third party that arises out of your work, services, or conduct outside the app.
By accepting these Terms in the app, you acknowledge that you have read and understood this section.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, GigMe and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid GigMe in the twelve months before the claim arose (which, for most users, is zero).
We may update these Terms. Material changes will be announced in the app or by updating the "Last updated" date above. When we make a material change we bump the version shown above, and the app asks you to accept the new version — recording which version you accepted, with a timestamp, so both you and GigMe have a clear record of what you agreed to and when.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
